THE FERN - TERMS & CONDITIONS
1. Rental Period
The rental period begins at the agreed-upon start time and ends at the agreed-upon end time stated in this contract.
All setup and teardown must occur within this rental period. Early access or late departure will incur overtime fees.
Overtime is billed at $150 per hour or portion thereof.
2. Deposit & Payment Policy
A deposit is required to secure your booking.
All deposits are non-refundable.
Only one date change is permitted and must be requested at least 6 months prior to the event date; date changes are subject to availability.
Remaining balances must be paid in full by the due date indicated on the invoice.
Accepted payment methods: cash, credit card, Zelle, or check.
3. Capacity & Safety
The Fern’s maximum guest capacity is 75–90 guests depending on layout. Guests may not exceed the capacity stated on your invoice.
Exceeding capacity may result in immediate shutdown of the event, forfeiture of the security deposit, and/or additional fees.
4. Use of Space, Setup & Clean-Up
The renter is responsible for setup and cleanup within the rental window.
The venue must be left in the same condition in which it was found.
Trash must be placed inside venue trash cans; all décor, boxes, and personal items must be removed.
Confetti, glitter, feathers, rice, and similar items are strictly prohibited.
Any damages, excessive mess, or violations will result in additional fees charged to the renter.
5. Decorations & Alterations
No nails, screws, staples, adhesive hooks, or tape may be used on walls, furniture, ceilings, or floors unless pre-approved by The Fern.
No décor or structure may block emergency exits or pose a safety hazard.
Open flames, candles, sparklers, and fireworks are strictly prohibited inside and outside the venue.
6. Vendor Policy
All vendors (caterers, DJs, decorators, etc.) must be approved by The Fern in advance.
Vendors may be required to carry and present proof of insurance.
The renter is responsible for ensuring their vendors comply with all venue rules.
7. Food, Beverages & Alcohol
Outside food and beverages are permitted.
If serving alcohol, renter must obtain any legally required permits and assumes all liability for alcohol service.
The Fern reserves the right to refuse service or remove any individual who is intoxicated or behaving inappropriately.
No alcohol may be sold without proper licensing.
8. Smoking, Drugs & Illegal Activity
No smoking or vaping is allowed inside the venue.
Smoking is permitted only in designated outdoor areas.
Drug use is prohibited.
Any illegal or unsafe behavior may result in immediate eviction and forfeiture of all payments.
9. Noise & Music Policy
Noise levels must be kept reasonable to avoid disturbing neighbors.
All loud music must stop by 11:00 PM.
The Fern reserves the right to lower volume or stop music if necessary.
10. Parking
Parking is allowed only in designated areas.
Guests may not block driveways, private property, or emergency access zones.
The Fern is not responsible for any vehicle damage, towing, or citations.
11. Pets
No pets are allowed inside the venue.
Service animals are permitted in accordance with ADA regulations.
12. Damage & Liability
The renter is fully responsible for any damage to the property, furniture, or equipment caused by guests, vendors, or children.
Repair or replacement costs will be charged accordingly.
The Fern is not responsible for injury, loss, theft, or damage to personal property, before during, or after the event.
By booking, renter agrees to indemnify and hold harmless The Fern, its owners, agents, and employees from any claims arising during the event.
13. Emergency Protocols

Fire extinguishers and first aid kits are available onsite.
Exits must remain clear at all times.
14. Cancellation Policy
All deposits are non-refundable.
Cancellations made after final payment deadlines or within the restricted window defined on your invoice may result in forfeiture of the full rental fee.
Date changes follow the policy listed in Section 2.
15. Venue-Initiated Cancellation
The Fern reserves the right to cancel any event at any time, for any reason, at our sole discretion, including but not limited to personal, operational, or business-related circumstances. In the event that The Fern initiates a cancellation, the client will receive a full refund of all amounts paid. The Fern is not responsible for any additional costs incurred by the client as a result of such cancellation.
16. Failure to Comply
Failure to comply with any of the above rules may result in:
forfeiture of the $200 security deposit,
immediate termination of the event,
and/or additional charges for damages, overtime, or violations.
17. Agreement
By booking with The Fern and submitting payment, the renter acknowledges that they have read, understood, and agree to all terms and conditions stated here.
